U.S. Supreme Court rules that cities cannot mandate taxi drivers to use hybrids only

    Just to clear the air,
    the US SCt declined to hear the case. They didn't "rule" on the issues involved.
    That means that when the case comes up again, the Supreme Court has the authority to decide as it wishes (or to duck again), without having to overrule their own precedent.
    The lower court case remains precedent for its jurisdiction (2nd Circuit, I believe).

    I haven't studied the issue thoroughly enough to have a reasoned opinion on the merits of the decision.
