    In a Gen.II or Gen.III?
Because in the Gen.III if the engine and battery are not wormed up, it will only go to 10mph, but if it's all wormed up and the battery's SOC is at a good level, then 25 is the top speed when the EV button is pushed. You can go faster in EV, but when the car is in EV mode (as in the EV button was pushed) 25mph is the max speed. I don't know about the Gen.II though, because they had EV buttons over-seas.

So the Gen.II can go faster in EV if you have the button?

At 43mph indicated you are only going about 39mph because the speedo reads higher than actual speed. I find I can stay in electric only mode up to an indicated 46mph even with oversize tyres (205/55/16) that make the speedo more accurate.

I have seen my 07 do the same… doesn’t make sense… and the ice still kicks on with all green battery bars with press of gas pedal above 15%. City mpg is around 38mpg, above 40mph… mpg is 50mpg+ completely opposite of advertised mpgs…
