The technical requirement in terms of hardware seems to be LCA being fitted (which implies side radar, driver monitor and touch-sensitive wheel) and navigation information available (so onboard maps, or subscription). Tecnical requirement might still not be fulffilled here (or Japan) e.g. because some redundant sensor is missing. Its like Tesla FSD. Even if they could perfectly drive with that HW, they would never get Level 3 in Europe as they dont have enough fallbacks/redundancy.

I tried to find wheter there are specific requirements in EU for level 2+ but did not find anything interesting yet.
