Should the bold text read "right" lane? You were coming up in the left lane?

As to the other car's destination, maybe it was that that two-way left turn lane in the centre?

 

Sorry to hear about your accident. Your car is definitely a total loss, and the other driver is at fault.

One thing that no one else has brought up, as an owner of a dark gray (winter gray metallic) Prius, I can definitely say that when you drive a charcoal gray colored vehicle, you might as well be driving a stealth car that blends into the surrounding blacktop roadway. There have been many times when other drivers have pulled out in front of my oncoming car like I wasn't even there.

I have installed DRLs, which my 2011 did not come with from the factory, and it has helped immensely to make my car easier to see.

When you do get a replacement for your Prime, I'd recommend getting a different color. Stay away from charcoal gray and black vehicles, and always use DRLs, if equipped.

It will depend on how busy the adjusters are. The car that crushed our car was insured by Geico and they did well. They started poorly though with offering a fair price for a base trim Gen two. When I explained that it was a trim 6, they increased the payout quite a bit, plus gave us part of what we had just spent on air conditioning work and a brand new 12V battery. We got our check just over a week after the accident. It would have been a couple days quicker if not for their wrong assumption of the car's value.

The lawyer recommended to us by a good friend who used to be one of the prosecutors here did a great job for us. It was a royal pain for almost a year with all the treatments and fighting with medical providers and insurers. But, once we got the lawyer involved after the first few months, we were finally able to feel a little more optimistic and not be spending all our time on the phone. He saved us a ton of money and untold hours of haggling. I'm not a fan of lawyers in general because so many are crooked and people over use them. But in this case, I'd say ask your friends who they would trust and get one. Your life will get a lot less complicated.

GAP (enough of this word already) insurance only covers what you owe on a financed or leased car.
Replacement insurance covers you if you paid hard cash as in a money order or cheque (check for you Americans)
Where I live, I have 5 years of new car replacement coverage in case of a total loss on my 2018 Prime.

 

About hiring an attorney...what damages did you suffer in addition to the loss of your car? Add those up. If it isn't significant, it isn't worth the lawyer's time to take your case. If you were injured, take all the time you need to get stable and recover as much as it will recover before you sign off on any settlement for the injury. You can sign off on the car settlement as soon as you feel it is fair, and keep the injury settlement open until you know more.

Read and understand all the fine print in your insurance policy. That's the coverage you bought, so that's what you can expect to get from them--if everything goes right. If you use a local insurance agent, put the agent to work for you. They may get their calls answered more quickly than your calls get answered.

Not quite. Gap coverage (if you bought it) covers the difference between what you owe and the car's book value. I'm not familiar with insurance for leased cars. I've found the cheapest place to buy Gap coverage is from one's own insurance. The most expensive is from the dealership.

 

Quite possible, although then again maybe not. Yes the proper procedure is to always turn into the two-way lane first then merge into the traffic lane. However someone could argue (not me) that if there is no traffic coming from the right, but traffic approaching from the left, that it would be safer to go straight across in order to get clear of the oncoming cars faster, then essentially conduct most of the left turn in the traffic lanes on the other side, since there are no cars on that side. However the reason I say I wouldn't make that argument is because if the oncoming cars are close enough for that to make a difference then I'm not going anyway, I will wait until it is safe. But I'm just saying that is what I think goes through some people's minds in these situations. Either she saw the Prius but misjudged his speed and thought she could shoot across in front of him, or she didn't see him, but not being 100% sure that there were no cars coming she decided to shoot straight across. Or like you said she planned to turn into the two-way lane. All are possible. Maybe if we eventually get to see photos of the other car it will be possible to make a better determination.

By the way I always remember my high school driving instructor calling the two-way lane the "suicide lane". Maybe a bit over-dramatic but I always think of that whenever I have to use one.

Just want to say thanks for providing all of the information that you have. I realize you're still shook up, and also it's not easy to remember everything. We are picking this all apart only because we all want to be safe, and we are learning from your experience, at least I am, and I assume that you are also. Regardless of all of our armchair accident investigation discussions, I think everyone here wishes you the best that you will fully recover, and the financial reimbursement will go smoothly and quickly, and that you are able to get a nice replacement car equal to or maybe even better than the one that you lost.

 

Incidently, if a driver, road worker, Policeman waves to you indicating to cross or whatever.....YOU are still responsible. So never let a cop rush you across a intersection, he’s not liable.

 

I'm glad you're ok. I'm still researching the functionality of Prius Prime Advanced. If anybody has time, what and how did the feature of Prius Prime Advanced help in this car accident?

This will come out of the other insurance company after you are found not at fault, DO NOT settle personal injury now, put it off til last. It’s your wedge to getting a better car deal. Making a fault determination can take a month or more. Any hospital care cost can be delayed and included in the settlement. Do not pay out of pocket.
