'10 Prius III died in the line of duty

    They do say that although distracted driving is rarely documented, that it is a real problem. But, the good thing that may come out of this, besides getting a nice and new Prius, is that the area in question may have changes made to the flow of traffic based on your accident. I would certainly make it an issue with the city. It sucks that it takes something bad like this to happen to facilitate this change. I hope that you don't have a three year battle.

    Am I the only one looking at the Emergency Medical Care sign in the original post? Rather ironic that multiple car
    crashes have occurred in this general area.....just saying.
    I am glad you are getting better and I am impressed by the air bags, just wish you didn't have to see them deployed. Heed the advice on future physical problems due to this accident, I truly hope you never have anything
    show back up, but it is hard to tell at this point. My daughter was involved in a very similar accident 20 years ago
    when she was attending college, we settled with the insurance company, just happy to have her car fixed. Around
    10 years back she started having periods of a lot of neck pain, which her doctor now says probably is attributable to
    the injuries she received in the wreck. To add insult to injury , she had, just a week before the wreck, made the last payment on the car.

    Grabbing the donut would have been the best idea ever. Wish I had thought of it, but I missed my opportunity and wasn't even thinking about the plug-in yet. I cleared everything out of the car at the crash site, so I just released it to them then & there.

    I did grab the all-weather floor mats, which should work in the Plug-in, although the GT Cover seat covers are still an unknown. I am not quite good enough to go crawling around in the car yet to try the install. Maybe next weekend.

    Call the shop that was holding the car. It may still be sitting there and often they will remove that for you. I had that happen when my car was totaled. I was so distracted that I didn't think about removing anything, so we called them, they removed things and had them waiting for us. We then realized that I forgot to remove my license plate, and so we did it when we got there. Sometimes they are quick to remove cars, and sometimes they take a while, but it can't hurt to call either way.

    As always...glad you are okay...or at least recovering well.

    If it was me? From an insurance standpoint I'd wait until everything was just about settled. Then I would very formally have your Lawyer put in a carefully written request for reimbursement for one large coffee.

    I think you could save your money and have the insurance company request it. I am sure they would happily give you a Starbucks or whatever your preferred coffee is card.

    Glad to see you're not seriously injured.
    My niece just got hit (while standing at a stop light) a few weeks back- if I could offer some unsolicited advise as others here have...

    GET A LAWYER IF YOU HAVEN'T YET!

    I can't state that strongly enough. Without a lawyer- you're simply another sheep who will get taken advantage of by the insurance co's legal dept. If you have injuries- future complications may crop in six months or even a year or two later. If you have a lawyer on your case- you will be covered for future expenses, without one- tuff luck charlie!


    FWIW- I also dislike the legal system, but it's so skewed in favor of the insurance companies, the average non-lawyer just doesn't have a chance for fair compensation. A co-worker's mother in-law got hit about 2 years ago. She thought she was alright, but months later she needed chiropractic care, dental surgery, CAT Scans, etc... and missed many, many days of work. All due to lingering after effects of the accident where she refused to go to the ER to get checked out and she had one of her children fight the insurance co to get her vehicle repaired. She told us that in the old country (Poland) nobody gets lawyers for 'minor' accidents. The thing is- what she thought was minor has turned out to be a major incident 2 years later. We just found out last week that she may not be able to work any longer since her aches and pains still persist...

    OP, sorry for your loss of a reliable and dear ride. FWIW, I don't think the donut spare would've been recoverable since the back end was caved in by the impact.

    Out of round spare tires don't roll so good. ;)

    My wife got rear ended by a Ford Windstar many years ago while at a stop. She was in a early 90s Acura Integra.

    The force of the colision was
    so great that her car was shoved under the rear end of a Nissan pickup truck in front of her. The rear wheels were above the front doors of her car.

    17 years later, my wife still had neck pains from that accident from time to time. Additionally, she used to enjoy riding rollercoasters, but she can't now because after even one ride, she gets neck pains and severe headaches.

    Oh God.

    She was probably texting.

    I had a near-miss with a car that braked abruptly in front of me due to the next vehicle taking a right turn and she almost didn't notice in time.

    I took a clear spot and passed in the left lane and my daughter told me that the driver had her phone held up to the dash and was texting.

    That crap infuriates me.

    Well, my recovery has stalled out. I think I am headed for MRIs on both knees. I am going to get some physical therapy to see if it helps, but I am really not having a good time. In the evenings, I teach martial arts and right now I can't even stand long enough to teach a class, much less actually demonstrate anything. I can't take my kids to a birthday party tomorrow because I can't chase around after the little one. I am hoping that the swelling will go down and things will be back to normal, but right now there doesn't seem to be much progress :(

    I guess the other thing I should come clean about is that I am also a lawyer. The insurance company will be paying for plenty, including the cost of a tall Pike's Roast (Excellent suggestion!). I am experiencing the latent effects of the crash, and I have been careful to document treatment, symptoms, etc. The medical expenses are at least a relatively straightforward exercise, but he non-economic damages are really tough to calculate. I am finding that out in a much more concrete and non-academic way than all the theory, motions, briefs, and jury verdicts I have read could have expressed.

    On the upside, I am getting 120mpg + on my commute with a charge at home and a charge at work on the Prius Plug-in.

    I was going to say that you will definitely feel worse 24 to 48 hours after the accident. That's when all the inflammation kicks in.

    Ibuprofen will help keep the inflammation down.

    That's good news.
    My niece is a lawyer- but she's a tax lawyer and realized it was not something she was familiar with , so she found a good personal injury firm to represent our other niece (her cousin) who was recently hit.

    Best of luck to you for a speedy recovery!
