R.I.P Little Green 09' Prius

    So... I bought an 09 Package II Green Prius (Silver Pine Mica), used on 3/31/11.

    on 9/13/11 my husband was innocently driving to work in stop and go traffic, AFTER dropping the kids off thankfully... and a 2000 Chevy S10 SLAMMED belligerently into the back of my prius while my husband was at a stop, estimated by the collision shop 46MPH. He was thrown 7 feet forward and put a minor scratch on the bumper of the Volkswagen in front of him. The guilty party had state minimum coverage of 15k and since the floorboard broke and nailed the hybrid battery casing and jarred it enough to cause capacitor damage (or something... lol) caused $20,800 in damage....Had to call up my collision coverage to foot the bill. Husband is ok. Prius was a "total loss". Here are the photos... took three weeks but last night we finally purchased a 2011 Package II Blizzard Pearl Prius. :) So I will be moving to that forum, but I wanted to show you what happens when an a*hole slams into you. I'm glad everyone was ok and this has been a complete nightmare... struggling to get payout and being treated TERRIBLY by AllState even though the guy was ticketed at the scene and they deemed him 100% liable for BOTH accidents.

    The body of the car, the metal part not the plastic, was jammed into the back wheels, (yet the tow truck driver still didn't put it up on a damn flat bed, just let the back wheels smoke and burn like hell instead of calling another guy out...) and the frame and axles were just annihilated. My car would NOT have been totaled had the hybrid battery not been compromised...but at this point I am kind of glad it was since I guarantee even fixed it would NEVER have driven the same again.

    Here you go. I have about 15 more both pre and post disassembly if interested.

    And for reference.... A VERY totaled Chevy S10.... The guy was a COMPLETE jerk, lied to the cops (Cop wrote him a $400 ticket) told him AND his insurance company that my husband cut him off from the LEFT which isn't possible because they were IN the LEFT LANE and there was grass, concrete median and split highway to the LEFT.... so my Prius would have had to sprout wings and FLY across the highway, he screamed at me when I showed up on the scene to retrieve my severely whiplashed husband. :( If this guy was going to throw down, (he was acting very agitated and cursing and kind of cagey) he was going to have to get through all 5'4 of me! LOL I wasn't going to let him get to my husband!

    Oooooooooh I LOOOOOOOOOOVE it!

    I really do miss the big display screen. Hubs is putting in a big square navigation + touch screen radio in that spot for me. :)

    My car was also killed by a Chevy S10 which eventually led me to buy a Prius.

    That is really unfortunate... :( Apparently Chevy S10 drivers need to learn to find the brakes.

    Wow that's too bad.

    You know, any accident is a traumatic experience and a "bad day". On one hand? I guess your lucky it seems it was primarily simply property damage. On the other hand? If the police were present? The S-10 driver shouldn't of been allowed to be so agressive. They wrote him a 400 dollar ticket, but they should of told him to shut up. Regardless of what he thought happened or what he was trying to sell as happened...yelling at you, or anyone at the scene is ridiculous. A good cop would of backed him down.

    He did this when the cop was inside his car, one car back, working on the driver exchange form and the report. There were traffic control guys "emergency Management team" but they are not allowed to intervene??? lol

    Well, look at the bright side. You've got a Gen 3, and probably one of the last ones that will be produced without a noisemaker or "vehicle proximity notification system".

    I think it's impressive how many posts I read from people who lose a Prius..and replace with a Prius. That type of loyalty speaks well of the Prius.

    The green might be gone, but it's time to move on...hope your husband is okay...before you sign off on anything make sure his whiplash...is just whiplash..and he is physically okay.

    Also, we are not signing off on ANYTHING until he sees our family doctor again and potentially a specialist just to be sure. He is still having a few burning/stinging pains when turning too quickly, hard to know if it is 'healing pains' or.... something more? XRays show no disc or vertebrae shifting. They want to offer us a settlement on the injury, husband is reluctant to take it...no dollar amount offered yet.

    Wow what a jerk, I hope your insurance company sues his nice person for the balance of the damage over 15k.

    Anyway, good luck with the new Gen3. :)

    Yeah, Illinois has not increased their state minimum coverage of $15k since 1981.........

    WAY behind the times with all of these new hybrids and technology on the road.

    Going to write the state representative....

    NC started to (finally) update their insurance policies last year. In addition to higher minimum coverage, everyone now MUST have underinsured/uninsured insurance.

    In Illinois it is either Collision or Uninsured. You can't have both.

    Also, Uninsured and Underinsured are completely separate things. Uninsured motorist will NOT cover UNDERinsured motorists and vise versa in IL.

    So I owed $21,600 on my Prius.
    Received $1800 refund on my warranty. Balance = $19,800.
    Received $17,650 for CASH VALUE of my Prius. Balance = $2150.00
    Received $1478.82 Sales Tax reimbursement for 09 Prius = $671.18 balance....after ALL is said and done.

    I'll make the final pay off in November. October's payment of $443.00 will hit in the in between time before the NEW Prius' payment is due and I'll owe a couple hundred bucks on it in the end.

    Nothing I could do. No insurance company is obligated to negotiate the payout and we didn't possess gap.

    However, the 2011 Prius you bet your sweet tail has gap. No warranty though. When all of this happened, MY OWN insurance company told me I wasn't carrying collision. BULL! I told them to show me proof where I declined collision coverage on car that was financed through a company that REQUIRES collision coverage. They couldn't produce a signature -- so they backdated it. :)

    Sorry to hear about your total loss. I was hit in my 350Z by a driver in a convertible Mustang (didn't realize traffic was stopped ahead and skidded into me). I would recommend seeing a chiropractor and making the other insurance company pay all your medical bills. If they resist, get a lawyer. Also, I had to get pressure point massages (very painful, but I was getting muscle spasms after the accident) for a month before my muscle spasms stopped. I was hit at about 20mph. Wish you luck in sorting out the total loss and your husband's quick recovery.

    glad your husband was ok. 48MPH ... wow!

    Always was told to never say anything, regardless of what happened. Bad enough your in an accident and then you (not you but husband) take abuse?

    I was a good guy and settled with an insurance company over a fall. 30 years later I'm still paying for treatments to my back, don't settle, get a lawyer, bad backs last a looooong time, trust me. By the way, I'm not a lawyer.:eek:

    In this under insured situation, his, not yours, and the fact that hubby is banged up, you really do need to at least speak with an attorney. The first visit is always free. I really think you need some professional help on your side since Allstate does not seem to be putting forth those "Good Hands"....

    AllState paid for his initial ER visit since I put down the guilty party's insurance info on the report so we paid nothing.

    Family doctor had a $10 copay, told him to come back in 3 weeks if he was still having neck problems.

    AllState said they would check back with us also after those 3 weeks to make sure he was feeling better and needed no further treatment.

    He woke up this morning with a very very stiff neck and has complained about it all day. He and I work at the same place and we drove to work together this morning and I could tell he was agitated. I urged him to go back to the family doctor and see if he can refer him to a therapist...

    I didn't think I would need an attorney but they want to put my husbands injury into "Colossus" and offer him a settlement. I told my husband DON'T do it... the cash money is TEMPTING.... but - we are not hard up for it in any way so we are holding out.

    After reading this thread I may just consult an attorney most likely after my husband sees our family doctor again.
