    Perhaps I can help.

I ordered a Prius 5 with ATP in July. It arrived at the dealor last monday and I picked it up Tuesday. It is as new as one can get on the east coast.

On the car sticker (that never made it to the window) is the pase cost of 27,270
and below that is a package called AT Advanced Technology Package for $4500

Yes it has Lane assist (neet feature) and radar cruse control and the parking options with a 4 disc cd changer.

So yes indeed the latest shipment to the east coast with ATP does indeed have all the features you were expecting.

The ATP package includes the NAV package. The NAV package alone is I believe only $1800 and only includes the Nav and not the all the other features.

    Hope that helps

    Stan

By the fact that you didn't even look at the papers to check if AT was there before you signed them (you didn't notice it until you drove off the lot) and the price difference. Anyone who truly wanted AT would have taken notice when the price was $2,800 less and not accept it like you did if they didn't get one.

Nevertheless, I'm glad you're happy with the car and that's the important thing.

I can relate to the OP and his frustration here.

Either way...good for you for finding the positive in what you have. If it was me, As a courtesy, I would send an email to the owner(s) of the dealership, the salesman boss, and the gm..explaining why myself, family, and friends are no longer going to patronizing his or her dealership for both purchases and service.

I would also ask for a refund on the extended warranty I purchased.

You've been a PriusChat member for 4 years, and you're just now observing this behavior and coming to these conclusions?:p

I'm certain you did your research and knew what you wanted. You were, basically, taken hostage by this dealer and felt you had no place to turn. I understand the scenario, and I don't know exactly what I would have done -- though I'm pretty certain I would have made it abundantly clear that I was a lawyer and could call the State's Attorney, Attorney General and a few other folks while sitting there in the dealer's office. Would all of that bluster have resulted in anything different than what happened to you? Who is to say?

    I remember the first time I had a thread hijacked . . .

Really, there are many of us who are willing to argue at the drop of a hat. Some want to "debate" while others want to "discuss" -- even others just want us all to get along.

Seriously: I do hope you push this a bit with Toyota, because the dealer is likely to try this again to someone who may not be able to keep his or her head screwed on straight.

My earlier recommendation to take it to the dealer first still stands. The second step of going to a lawyer does not appear either necessary or reasonable, unless you go to your local State's Attorney or State's Attorney General. These lawyers are the ones charged with being the lawyers for the people of your state. They will want to know about distasteful business practices, particularly those involving the sale to consumers of high-priced items.

Please stick with us and let us know what you think of your Prius V -- including pictures!

As a lawyer, you would have double-checked that the sales contract contained the AT package and refused to sign it if it didn't, yes? The OP didn't do either and failed to notice it until after the fact, hence the messy (and easily avoidable) situation.

I'm glad to hear you have that kind of faith in me -- I was a bit concerned after reading your earlier post's comment on lawyers.:D

Actually, the sales contract has very little value, unless it is signed far in advance and causes people to act in reliance upon its terms. There are dealers who will present contracts at the time a car is "ordered." You may be asked to sign such a contract, but it really has no value until the dealer signs. And the dealer will not sign unless there are clauses allowing the dealer to change the price or other significant terms (depending on availability and a long list of other contingencies).

If I signed the contract, saying I was buying a Corolla, but I paid the price of a Prius, and I received the keys for the Prius, and the Prius was registered in my name, and I drove the Prius off of the lot, the contract would not allow (nor would any judge) the dealer to repossess the Prius from me and replace it with a Corolla.

There are many things signed at the closing on the purchase of a car. The ones that really matter have to do with the car's registration and the acknowledgements and the limited warranty documentation.

If the contract described a Prius V with Advanced Tech Package, noted a price of $32,750 or so (pre-tax, registration, etc.), required full payment of that amount, and the dealer signed the contract and then accepted a check from you, NOW you have a truly enforceable contract. I would then be what we call an executory contract.

I believe the OP found out about the situation before he ever completed the deal. Hence all of the discussions and the dealer's lies. The OP could have walked away, but then what would become of the truck or the necessary transportation for his family? This is the quandary he faced -- and the same I would have faced.

It may seem like all these people are angry at you and jumping on you Basildane, but that is not the case. They are angry FOR you and frustrated because you're not as angry as they are for yourself.

Its like having 70,000 mothers when the bully trips you on the playground LOL

You should post the sales contract (blacking out personal information, of course). It should clarify things.

    1. I'd focus on enforcing the contract.
    2. I sympathize with your problem, but it is an important oversight. How sure are you that you even have a package five? What kind of a deal did you negotiate if it turns out you only boght an 1800 NAV system, and not the 4500 ATP? A lot of questions here.
    3. Then they need to give you a loaner until they get something in that matches the sales contract.

First I am sorry of us seem so hard line with answers for you. Some of us are experts on the Prius compared to so called salespersons at dealerships. There are two Prius V pkgs.
    Prius V
    Prius V with Nav only
Prius V with ATP(advanced tech pkg) which includes NAV

If you paperwork says ATP and not preferred pkg I think you have a right to reject car.

The OP has already stated that he's happy with the car as is. There's no point in giving further advice or prompting the OP to pursue the matter further.

My suggestion is deal with the General Manager ASAP about your issue. Tell him you were mislead and you will not be made a fool of. You wanted X and got Y. Make them get you something or through an allocation, even if they make you take the car back and also if you have to get a rental, its the things you wanted. Your keeping the car for a while and no need to settle for less.

I do think those TOYS are just that, Toys and in time you will not use them as you once thought, or at least all of them. Plus there are variables to the functioning of those options. My car is just that a V with them and have not taken delivery and the more I read, the more I see where I may not always be able to use them, which in some cases is a bummer. (Bad road Markings, Cold climate, Humidity for the camera etc...) so there are some drawbacks. I will tell you though, the IV if that is the one you got, is one sweet car...

Weigh it out and if not, go back and make it clear your not happy and I think you should be able to work something out.
I wish you luck! Keep us posted on the site how you made out!
