Prius in AZ HOV Lanes ?

    I would think that one would tend to follow legislation and ISSUE The AFV plate as is written in the Statues regarding Hybrids that ARE approved by the Federal Government, i.e. The FHWA and subsequentlty the EPA, which is due out in December.
    Since the directors office feels that NO finacial incentive is due for cleaner cars, then they can take my Energy Efficient Plate plate and grind it up and stuff it in their freakin inhaler. And the next time Maricopa fails Air quaility standards, cut a check to the feds.

    I don't forsee any changes soon. The reason why is possibly the hub bub about the VLT. Though the MVD is ready to issue AFV plates with stickers to let the selected three(pri, insight, civic) ride in the HOV lane, there may be some legal issues that will open up once the plate approval goes through.
    First, the MVD's attempt to issue a new plate(energy efficient plate) maybe outside their legal capacity. So they may be forced to issue the AFV plate to pri owners upon application. When this occurs, Alternative Fuel Plate implys Alternative fuel vehicle, regardless of stickers. ARS 1-215 defines alternative fuel. Since the pri is powered by an alternative fuel, it can apply for a VLT associated with classically defined Alt fuel Vehicles(ARS 28-5805).
    MVD stance is that hybrids are not soley powered by alt fuel. I think a plausible legal argument can be made where the statutes never imply that an alt fuel vehicle needs to be soley powered by an Alt fuel alone. In this sense, the interpetation requires judicial review seeing that, I'm sure, the Attorney General has weighed in by determining Alt fuel vehicles are vehicles that are soley powered by one fuel. I see the States view on this, as it opens a hugh flood gate, however, the inclusion of vehicles that can be manually switched from alt fuel to gasoline in the ALT fuel plate program discredits their point of view.
    I beleive this is going to hold up FHWA pilot program and is why the above link, at the MVD web site, may have been pulled. The finacial loss to the state would be close to 10000 times the currently allowed VLT($300.00 avg.) It's a shame that this amount is being weighed against current ozone levels, for which the EPA has certified phoenix for being out of compliance and air quality with its health related problems. There is no finacial penalty for the State for EPA noncompliance.
    However, witholding access to this form of tax relief may open other doors: ARS 12-821.01

    I think the problem is with 28-737. EPA has yet to make the rules which would define which hybrid can use the HOV; ARS 28-737 para. F, sect. 5. Basically, the AZ law isn't in effect untill that happens.
    It is suppose to happen aound dec. 2006.
    However, a Federal Highway Admin., pilot program was approved on 8-17-06. Three hybids will be participating, prius being one.
    MVD is waiting, they say, on the Governors office to announce the program.

    If you use 28-737 as cause for allowing HOV use, they'll reply that no EPA rules have been released , so go away. ANd since 28-2416 refers to 28-737 to define hybrid, they'll reply, in a nut shell, to go away.

    The best alternative is to ask both Director Mendez and Governor Napolitano to please announce and put into effect the FHWA approved pilot program. But I don't think they'll do it b/c of the VLT. It's a grey area but it has merit. I think the State could loose. But I believe the VLT exemption/reduction is a positive move toward cleaner air and EPA compliance

    Well, I wish I would have read all of this information before I decided to waste 2 hours of my time waiting for someone in the DMV to tell me that the program was put on hold. This morning I called the DMV Call center and spoke with a gal by the name of Nancy at ext 5384, she informed me that in fact the pilot program was in effect and I could stop by the DMV and apply for my plates. As I was a bit apprehensive about driving by the DMV offices and waste my time, I asked her to please verify that the information she has just provided me was accurate; to what she responded, affirming her last statement.

    While at the DMV, the supervisor informed me that I would be 'notified' by mail by the DMV inviting me to participate into the program.

    Hopefully, someone will finally put an end to all this non-sense and approve the use of HOV lanes to vehicles that are environmentally friendly.

    Phew, gotta love fridays. The DMV, a part of ADOT, is way out of the loop. I will not go there for anymore info, unless I want to be lied to, point blank.
    If your going to get any reliable info its from an ADOT community relations.
    Of note, The HOV Pilot Program will probably be hung up for at least as long as the EPA hang up: 90 days.
    The EPA May issue their HOV/hybrid rules in DEC. Big maybe. It seems to me that ADOT has the best intentions, but the Peter Principle is alive and well. Plus the V8 contigent is throwing down to make sure the Molasses & Mornice person Brigade slurs in.
    Well folks, I guess that's it. Back to Tombstone to count the dead.

    I'm a new member. Great forum.

    Good to hear the AZ governor has issued a directive to implement the special plates. I stopped in to the DMV in Surprise around August 30th, and they had no idea what I was talking about. We love our Prius. My wife loves it when the battery goes green.

    Just picked up a 2007 last Tuesday...mmmmmmmmmmm nice
    I have been in touch with ADOT and have sent several queries regarding implementation of the Energy Efficient Pilot Program. Maybe we are getting closer. Here is the response I received:


    We are just awaiting final approval from other state agencies having HOV lane authority to issue Energy Efficient license plates to hybrids for HOV lane usage. Thank you.



    So maybe.....closer..? :unsure:

    I just ordered mine too! You better be quick - only the first 10,000 applicants get one for the pilot program. This is only available for Prius, Insight, and HCH. I think the $9.50 will be worth every penny with the time saved on the 51 and the 10!

    I am a little worried about the stupid people who drive slower than everyone else in a misguided attempt to be self-appointed pace cars. If these idiots gum up the works, the HOV lanes will no longer be any better than the regular lanes!

    Slow pokes could ruin it for all of us. This is only a pilot program.

    This is my first time posting, so please bear with me. I hope I am doing this right.

    I just read in the Arizona Repulic that the Governor has finally approved Hybrids to use the HOV lane, effective February 9th.

    You can go to www.servicearizona.com to apply for your plate and sticker. It is a pilot program and they are only going to have 10,000 plates. The fee is $8.00.

    I just applied for mine online and I hope this post helps all of us who have been waiting for ages for this to happen.

    It is about time for an end to the obstruction of this law. The Governor is taking credit for a law that was passed by the legislature on or before 1997! She is using hybrids as a political football to make her look like she is doing something about the smog.

    Hey NoSpam, where do you see old fuddy-duddies driving our freeways? :lol:

    I drive the 51 and the 202 to get to work, and most everyone is going at least 75. This is around 6:00am. Not a cop in sight.

    On the drive home, I'm sure everyone would like to drive 75. But all those cars get in the way. ;)
