I have 2007 Prius in California that had the cat stolen and no insurance coverage. 215,000 miles, burns oil, and constant misfire codes. It is up for registration renewal in April. I don't want to spend the $$ to fix it. How can I sell it as is?

Make sure you write "Parts Car Only" on the bill of sales and file the proper DMV paperwork. If you don't mark it as parts car, the buyer can come back after you for emissions and brakes, it's part of Ca. DMV laws - even on an as is sale. The previous owner is responsible for emission and brakes (safety issue).

    Hope this helps.

Is there a special DMV form that needs to be filed for a "parts car"?

Standard DMV car sales form. Have the buyer sign your "parts only" sales form and write his/her driver license number on it. That way they can't say they didn't sign that or that you never disclosed that. Hold onto it for a year or two, just in case the buyer decides to take you to small claims court for it not passing emissions. Anyone who refuses to show you their ID or don't want to sign the sales document, you don't want to sell it to them. They're probably planning to do something shady - you don't need to be dragged into those problems.

    Good Luck...

Thank you all for the help with my non-CARB Prius. I have another question.

If I take the car to a STAR test station and they determine the CAT is non-CARB are they required to report that and will there be any consequences for me even though I will plead ignorance? I live in San Diego and I bought the CAT on ebay with the listing stating it was all 50 states approved. It was shipped to me in California from a California location. At the time I was unaware of the CARB restrictions. By the way the seller has since disappeared from ebay.

Would I be better off removing the CAT and selling as parts car without a CAT?

If the smog station catches the non-CARB CAT they won't issue you a smog certificate. That data is automatically sent to DMV, so if you take it down the street - the car will already be flagged non-compliant and you'll be required to go to a referee smog station. The referee stations will go over your car with a "fine tooth comb" about as enjoyable as a colonoscopy - unless your into that sort of thing......

You can ask Ebay for a refund based on incorrect description; wasn't 50 state approved.
