Tesla Faces Deepening Criminal Probe Over Whether It Misstated Production Figures - WSJ

Even as the company breaks production goals - the Fed's investigate the bygone days of 'production hell' - low numbers, from months ago. Some media outlets frame the FBI inquiry/investigation as a full blown criminal probe. Man - this company .... it just can't avoid being under attack - now that they're coming into their own.

Several folks in my circle regret missing out on recent bargain pricing. If it spooks investors and stock dips again, there are those who would be drawn in at <$300/share price.

The SEC and the FBI are at the service of corporations... They're going after Tesla in many ways because there's alot of corporations that stand to loose in huge ways by what Tesla is doing to many markets that have long been controlled by a small number of powerful corporations.

Of course the irony is that Tesla is also a corporation, so much of this bullying Tesla stuff is for PR purposes because the SEC and FBI serves corporations...

More specifically, SEC investigates and determines that a tweet by Musk is grounds for illegally influencing the stock market and then a high level figure from the SEC meets a well-connected billionaire who invested in Tesla and everyone's attorneys join in for a round of golf on a Saturday and by Sunday the SEC announces a settlement and crucial to all settlements the SEC does, Tesla admits no wrongdoing so all fines paid are just a tax write off/business expense and not really a fine that someone guilty of a crime would pay...

Likewise, an FBI investigation may soon determine that Tesla committed a crime by over-promising more than it was capable of producing earlier in the year... A stretch for sure, but if they do determine this is a crime than another round of golf with someone from Trump's clown-car cabinet and Tesla announces a settlement where they pay a fine and admits no wrongdoing.

    Isn't corporate america great!!!

Conspiracy theories are one thing. What's truly an irony is Tesla regulators didn't give a rip when the Roadster was slow to produce & late. They didn't give a rip when the S was slow to produce & late. They didn't give a rip when the X was slow to produce & late. But start cranking out at a rate nearing a ¼ million a year?
hmmmm. as they said in The Wizard of Oz; "that's a horse of a different color! "

The speed at which the SEC attack was resolved not only says alot about corporate immunity, which in this case is good news for Tesla and bad news for everyone who thought they could profit off of keeping electric car's off the road at scale indefinitely. But now that they've realized they failed, their attacks against Tesla will become increasingly more desperate.

What's more... Last Monday, Wall Street "experts" predicted that previous quarterly losses of $3-$4 per share would this quarter be only $0.02 per share and they were off by $1.78 per share. As in Tesla, even at this early stage is making a PROFIT for share holders!!! Those are enormous number discrepancies from supposed experts! And I don't think Wall Street is done underestimating Tesla yet.

As in once you calculate the long-term market value/dominance caused by having a Tesla charging station withing a 150 miles of 99% percent of the US population, you're not just looking at a car company disrupting/destroying the car market, you're looking at an energy company disrupting/destroying a vital sector of the energy market.

yup, nothing has or will change. the people have to rise up.
unfortunately, 2 or 3% of the driving public isn't enough. we can't get into politics here, but i hope cali can stand up to the pressure.

Way easier to win against washed up old cronies who are losing market share... There's blood in the water and all the sharks are starting to gather... Every major vehicle builder in the world is announcing future designs that are no longer chained to fossil fuel loyalty. And with solar going after the electric grid in a way that never seems to stop accelerating... The cronies of fossil fuels are already circling the drain!!!

They had their chance to do that... It's too late now... Tesla has so much momentum that they're already building additional factories in China for both battery production, as well as vehicle production... There's simply not much that can be done at this point because Tesla is generating Billions of dollars in revenue every quarter at a profit, not at a loss.

It’s almost impossible to prove a company knowingly made falsely optimistic statements to procure a more favorable investment environment for itself.

If Tesla is in trouble for making overly optimistic production statements, many companies would be in trouble if the same standard were applied.

    Well let's start with:
Report: FBI conducting criminal investigation into Tesla

Report: FBI conducting criminal investigation into Tesla

    Associated Press
    The Associated Press
    Associated PressOctober 26, 2018

A published report Friday said the FBI is conducting a criminal investigation into whether electric-car maker Tesla misled investors by overstating production forecasts for its Model 3 sedan.

The Wall Street Journal reported that FBI agents have contacted former Tesla employees to interview them. The paper cited anonymous people familiar with the matter.

A Tesla spokesman said the company was transparent about the difficulty of increasing production of the Model 3. He said the company cooperated with a "voluntary request" for documents from the Justice Department earlier this year and has received no additional requests on the matter for months.
    . . .

    We heard this tune before:
Tesla, Elon Musk win dismissal of lawsuit over Model 3 production | Reuters

Tesla, Elon Musk win dismissal of lawsuit over Model 3 production

(Reuters) - A federal judge in San Francisco dismissed a securities fraud lawsuit in which Tesla Inc (TSLA.O) shareholders accused the electric car company and Chief Executive Elon Musk of misleading them about the progress of production of its Model 3 vehicle.

In a decision made public on Monday, U.S. District Judge Charles Breyer said that while shareholders claimed that Tesla fell short of its production goals, “federal securities laws do not punish companies for failing to achieve their targets.”

Breyer said the shareholders have until Sept. 28 to amend their complaint. Their lawyer, Laurence Rosen, did not respond to a request for comment.
    . . .

Looks like someone is taking a second 'at bat.' After the civil suit failed, someone with legal skills (lawyer Laurence Rosen?) filed a criminal complaint. Until we see any court filings, all we have is FUD.

    Bob Wilson

ps. Before the 2016 election, I had subscribed to the Wall Street Journal and New York Times. Then I noticed both had problems with facts and data. In particular, they both would 'bury the lead.'

They would publish an article with an inflammatory title and then 3-4 paragraphs later, the title was completely debunked. In the case of the Wall Street Journal, this is classic Murdoch. But the New York Times also has more dirty laundry.

Before the 2016 election, the Times knew Trump's Russia associations were under FBI investigation and remained silent ... unless there was a Hillary Clinton investigation to report. Then there was Judith Miller who became a de facto press secretary to the GW Bush administration.

Funny. If they bought up all the patents wouldn't they have expired by now?
