I did take it up with Toyota corp. They had a field tech come out and basically do the same thing that the dealerships did (run a diagnostic, and check for error/telemetry info). After that, they said that there is nothing they can do. Of course none of this is documented through the dealer ship. My interaction with the Toyota rep was verbal only. The agent does not have a direct line, and they do not provide a direct email address to the agent handling the case. No documentation was offered or given from Toyota on what was done even though I requested it. They seem to keep themselves rather insulated...

I also have a complaint filed with the NHTSA at this point. They are asking for additional information, so there is some follow up and my complaint is showing up on their web page for 2017 Toyota Prius. I suspect that I will have to look into a lawyer at this point. I'm thinking arbitration would just be spinning my wheels. :-/

Pretty sure that California has a strong consumer protection lemon law.
Have you told the dealership that you filed with the NHTSA ? Have you told Toyota ?
Have you mentioned the lemon law ??

I suspect they don't really care much about what I do at this point sam. If they did, they would have made more of an effort in the first place. I figure that I will just have to keep at them until this is resolved. If that means lemon lawyers, complaints to the BBB, NHTSA, ect... that is what will have to happen. Sometimes you have to fill the book with pages before you can throw it at them. :-/ I am putting out my feelers to some lawyers this weekend to see if I might have a case (and if not, why?) The NHSTA does seem to be at least documenting what I my experiences have been so far. I'm not sure if that is just to document, or to actually investigate, but we'll see.

Not necessarily. Their first reaction usually is: Blow it off because they aren't really gonna get paid to do what is needed to find the problem.
IF......you make it appear that is going to COST them in a LOT of lost reputation points or administrative time and money to fend off inquiries from Govt. agencies and/or lawyers, their overall attitude might change.

You can't KNOW if you don't try. And assuming very often is a bad thing.

Yeah keep Toyota apprised of your intentions. It's sad to see a company that only reacts when their $'s and reputation are on the line, are happy to ignore you otherwise. I will keep this in mind next time I'm buying. If it ever happens.

They pretty much ALL worship at the alter of the almighty dollar.
The problem IS......that they have lost sight of the fact that good service MAKES you more money than it costs in the long run.

Short sighted......and small minded......has an adverse effect on a LOT of things these days.

Never heard that until recently, but it's being proven to be true!

When I spoke with the Toyota rep I did mention that I would have to go to arbitration at the least, so they did know I was willing to escalate this in order to get this resolved. The Toyota rep was more than happy to refer me to their arbitration forms & process. There just doesn't seem to be much (if any) interest from Toyota in actually trying to resolve this.

I placed a complaint with the BBB this weekend, and reached out to a lemon lawyer at this point. I'll post any updates as I get them. I suspect all of this will take some time... I'm wondering if Wes ever got his issues resolved. :-/

Done the lemon law thing on my own with a Honda. The judge will send out a person to document the issue if it can be replicated. If no one can replicate this then you do not have a case. Somehow it needs to be documented with videos etc.

If it remains an issue trade it at another dealer and move on or buy the extended warranty and suffer until it hard breaks.

Water in fuel comment is worth at least two cans of stuff in the tank.

Mine was easy as it had piston slap when cold and I knew what I was doing.

Thanks for the info ETP. We do have some video of this issue. Hopefully it will help. I'll trade it in if I have to. :(

Slightly off topic, but it's possible your mileage drop was related to the relatively short journey distance.

It could have been, but generally my MPG for city driving is better than 25 mpg by quite a bit.

I don't think so? One of the dealers did mention that my ECU was the most current. Does it apply to the Gen 4's as well?
