Recently I was driving North on the 405 in the Diamond Lane in the southern part of Orange County on my way to a meeting in Newport which is only 1 lane. The speed limit was 65 MPH. The cars is the other lanes had no traffic and were driving at a similar rate of speed. A Dodge Challanger in Black came up and tailgated me and flashed his brights. This is during the day time. I increased my speed to 70 MPH but refused to go any faster. My experience tells me that if you break the speed limit by 5 MPH the CHP may overlook giving you a ticket since it is within the +- error and I say May with caution. This guy became intense and decided to pass me on the right crossing the double Yellow Lane into the Non Diamond Lane passed me and crossed the double yellow line again to reenter the Diamond Lane. Than hit it and started to gain distance. I looked in my rear view mirror because I felt something was not right. In my Rear View I can see a White car gaining ground with a Red and Blue Light Flashing in the Grill. He passed me with ease in a similar maneuver as the Challanger did and before I knew it he was on the Challanger with full lights on as the Challanger started to maneuver across 6 lanes of traffic to the shoulder. The irony is if the Challanger would have just kept his cool in a few miles the Diamond expands to 2 lanes and he could have passed with ease and avoided multiple Moving Violations. Just saying sometime patience is a virtue.

I think it makes a difference if it is a carpool lane that allows unrestricted access to the main lanes (like most of them are in Northern CA), or if it is an HOV lane set off by double lines with designated entry/exit points (as is the norm in Southern CA). At least in CA, driving single in a carpool lane is a fine but is not a moving violation with insurance point implications, but crossing the double stripe definitely is, like running a stop sign. Crossing the double lines to match traffic speed would be a definite no-no. There is even some question about if one could be cited for crossing the double lines in response to being pulled over by an officer, but that is a bit iffy, since explicit instructions from an officer generally override the normal rules.

I'm not sure how he fought it, and I hate to keep being off-topic, but here's the relevant law
    V C Section 21654 Slow Moving Vehicles

Note the first sentence! Notwithstanding the prima facie speed limits, any vehicle proceeding upon a highway at a speed less than the normal speed of traffic moving in the same direction at such time shall be driven in the right-hand lane for traffic or as close as practicable to the right-hand edge or curb, except when overtaking and passing another vehicle proceeding in the same direction or when preparing for a left turn at an intersection or into a private road or driveway.

Hey, I was wrong. Should consult the dictionary in the future.
    I stand corrected :)

I usually avoid the whole problem by (legally) moving out of the HOV lane if 70 isn't fast enough for someone behind me. When the drivers in the HOV lane are going that fast, it is generally an indication that the regular lanes are open and moving at nearly the same speed as the HOV lane. It's just a bit unnerving to be going 60+ when cars just a few feet to the right are stopped or moving slowly. Every now and then, someone gets impatient and pulls suddenly into the HOV lane across the double yellow, so it seems to me most drivers in the HOV lane slow down under those circumstances.

I cannot put my finger on the relevant section of the vehicle code, but I recall reading that an HOV lane to the left of normal lanes does not count for the purposes of this law.

So if you are going 70 in a non-rightmost lane when the speed limit is 65, and most of the traffic is going faster, you could be pulled over and given two tickets: (1)one for going too fast, and (2) one for going too slow.

You might want to check your facts here. Nixon was the one who signed the legislation that made the national speed limit 55 in 1973. It was repealed in part under Regan in 1987 and 1988, and then fully repealed under Clinton in 1995. More info can be found at: National Maximum Speed Law - Wikipedia, the free encyclopedia

If we want to pick nits here, the 1973 oil crisis evoked the need for a 55 MPH national speed limited. The legislation was enacted by Congress and signed into law by Nixon. Though I don't think evoke is the right word here.

There are plenty of people who drives 55MPH with no car in front of them but TONS of irritated drivers behind that person in Long Island HOV lane.
I also drove behind one Prius whom literally tried to glide at ~40 MPH causing massive traffic behind. EDIT: Car plate FXP XXXX 3rd gen silver prius, if you are on this forum please don't do this. Your driving pattern is a hazard on the road.
Tons of drivers who stay on left lane going very slow here in Long Island and high beaming doesn't help either.

I thought I had a load of miles with 8600. Sheesh! I might just have a low-mileage trade-in in a few years if these are normal stats.

Hopefully the dealership isn't changing oil every 5k.

Also, curious what your EV% is.

I should probably win; leaving Banff with a full charge, dropping a few thousand feet in elevation traveling eastward, with a howling Chinook tailwind, and slip-streaming behind an 18-wheeler most of the way.

The dealership changes the oil at 10k intervals, and as for my EV% -> 79% gas, 21% ev. (Edited to correct EV%)
At every 5k, I get the usual tire rotation and regular maintenance inspections, last time in dealership did mention that my rear shocks we slightly leaking, and quoted me $500+ for the job. I'm under warranty to 100k so I'll get this done next time I'm in for $0.00 (y)(y)

i wonder if that's due to the extra weight of the battery?
