It seems that $9700 worth of damage on an '06 would have totalled it. At what point is it not worth repairing to an insurance company?

Somewhere near the point where the repairs add up to the worth of the used vehicle. An '06 must certainly be worth more than $9700. By 4-5 grand or so?

Years ago we had a 6 month old Subaru get hit.
I thought it was totalled, but the insurance company said no.
The other person's insurance company was paying for a rental.
Kept finding more and more "hidden" damage.
Including underhood, and under dash wiring harnesses, computer, and so much more.
Once the body work was done, they couldn't make it run.
All the time paying for our rental...........
Took weeks for every different part they needed like wiring harnesses and rack for the rack and pinion because it was a right hand drive vehicle.
Dealership said it easily would have saved the insurance company money to total the car.........but once the work was started it was too late.
They operate out of written giudelines............no common sense involved or allowed!

I called the body shop today for a status update. They've finished welding the frame pieces, and getting the body pieces ready for paint after the holiday. I asked if all the parts were OEM, and he said yes, they are all original equipment except for the tail lights, which will be aftermarket. I figure since they're replacing so much stuff on the car I shouldn't worry about the aftermarket tail lights.

Would it be wrong if I complained that they don't look like the original ones, if they look different? Would that be cause for them to get me tail lights that DO look like my original ones? Should I do something about it now, or just wait until I see the car again?

HAVE YOU SPOKEN WITH A LAWYER, YES?.....

and NO, 3rd party tail light assemblys and NOT ACCEPTABLE....

Get your LAWYER to put your foot down for you.

You did not ask to have an accident, they hit you, insurance or not, the only good thing that has happened is the Insurance Company has a non insured clause in the policy and you got your deductible back.

I can not say this enough, LAWYERLAWYERLAWYER!!!

I think you should visit the auto body shop when the parts have arrived to satisfy yourself regarding the appearance of the tail light assemblies. If you don't like how they look then you can complain.

Insist on genuine tail lights. Have you seen older cars about the place with faded tail lights? Not genuine, that's why.
